First IRS Whistleblower Reward Under New Program Paid to a CPA for Providing IRS with Valuable Information Leading to Collection of Unpaid Taxes
The IRS Tax Whistleblower Program has been validated with the payment of the first reward. It is important that a whistleblower select their attorney based upon knowledge, experience and ability to keep client's identity confidential.
ST. LOUIS, MO, April 13, 2011 /24-7PressRelease/ -- CPAs and accountants nationwide have taken notice of the recent announcement that the IRS paid an accountant a $4.5 million award - the first under the new provisions of the Whistleblower Program - for finding an estimated $20 million of tax underpayment by his employer.
The Whistleblower Program was enhanced pursuant to section 7623(b) of the Internal Revenue Code, which was enacted on December 20, 2006.
The new IRS Whistleblower law gives anyone with information about large-scale tax underpayments, including accounting errors or tax fraud up to 30% of any money collected based upon the information provided.
Former IRS Attorney Tom Pliske of Tax Whistleblower Law Firm, LLC was quoted as saying "this first payment of a tax reward goes a long way towards validating the IRS Tax Whistleblower Program. These are large cases and potentially difficult tax cases and taxpayers are not denied any of their rights just because an informant is involved. Therefore, it is not surprising that the relatively new program is only now making its first payment of the reward. This is encouraging news for all past and future tax whistleblowers."
A good tax whistleblower attorney should strive to shorten the payoff by providing the IRS with a well organized file when submitting the claim, similar to the IRS administrative file during an examination. This could potentially reduce the exam time by up to 12 months if certain documents and legal analysis are provided with the submission of the 211 Claim Package.
Although the tax whistleblower program appears to be a specialty among tax attorneys, it is important that one is comfortable with their attorney's experience and knowledge in tax law, and tax procedures as well as this new tax whistleblower program. As an additional bonus, one should look for an attorney that is willing to guarantee their confidentiality in the matter as well as one who will appeal their case at no additional cost, if necessary.
